Kaituhi Kaitiakitanga License

What is Kaitiakitanga?

Kaitiaki is a Māori word without specific English translation, but its meaning is similar to the words guardian, protector, and custodian. In this context we protect the data in this repository and will provide access to the data as we deem fit through our tikanga (Māori customs and protocols).

While we recognize the importance of publicly accessible tools and data, we're mindful that the majority of tangata whenua and other indigenous peoples may not have access to the resources that enable them to benefit from public goods. As tangata whenua, our ability to grow, develop, and innovate has been stymied through colonization. We must protect our ability to grow as tangata whenua. By simply opening access to our tools, data and knowledge, we further allow ourselves to be colonised digitally in the modern world.

The Kaitiakitanga License is a work in progress. It's a living license. It will evolve as we see fit. We hope to develop a license that is an international example for indigenous people's retention of mana over data and other intellectual property in a Western construct.

Kaitiakitanga of Kaituhi

1. The Kaitiakitanga of Kaituhi remains with Te Reo Irirangi o Te Hiku o Te Ika.
2. You may not use Kaituhi for:
   • Surveillance
   • Tracking
   • Discrimination
   • Persecution
   • Unfairness
   • Building Māori corpora
   • Mining Māori data
   • Anything that is inconsistent with the Māori Data Soveriengty Principles developed by Te Mana Raraunga.

Any attempt to use Kaituhi to build Māori data sets and natural language processing models is in direct violation of the Kaitiakitanga License.

Kaitiakitanga of Data Uploaded to Kaituhi

1. The kaitiakitanga of all data in Kaituhi remains with the respective kaitiaki that uploaded that data.
2. Each kaitiaki may make data available to others within their Organization or "Workspace" as deemed suitable by the tikanga associated with that data.

Kaitiakitanga of Data Processed

Kaituhi uses the Papa Reo API, which processes your data to enable features such as speech recognition and language detection. The Papa Reo API has its own Kaitikitanga License which is upheld by Kaituhi. In general,

1. The kaitiakitanga of all data processed remains with the respective kaitiaki that submitted that data.
2. Each kaitiaki may make data available to improve the Papa Reo API services as deemed suitable by the tikanga associated with that data.
